Avonside Cakery – Terms and conditions (February 2022)

By placing an order and paying the deposit you agree to these, our Terms and Conditions.

Price, Deposit and Payment Term

Your quote and these terms and conditions form the basis of the contract between us.  The quote is valid for one month from issue date.

non-refundable* 50% deposit is required in order to confirm your order. Although we will endeavour to inform you of any anticipated orders which may affect the availability of your collection/delivery date, we cannot reserve a collection/delivery date without payment of the deposit.

Once you have accepted the quote by paying the deposit, any subsequent changes to your order, including to the collection/delivery date, are not accepted unless agreed by us in writing. If the payment price increases due to such changes, payment of the increased deposit amount is required for us to accept these changes.

Final payment for your cake is required at least 48 hours before collection/delivery unless payment is being made by cheque in which case payment is required 7 days in advance of the collection date to give time for the cheque to clear.  The exception to this is for wedding cake orders where final payment must be made at least one month prior to the collection/delivery date.

* The deposit is non-refundable except in the case of cancellation by us.  Should we need to cancel your order due to sickness, in compliance with food handling and hygiene regulations, or to comply with local lockdown and social distancing guidelines, we will offer a full refund or delivery of the agreed product or a similar item at a later date may be agreed as an alternative. 

Delivery, setup & collection

Unless discussed in your consultation and detailed in your quote, we will not deliver your order.  Where we have agreed to deliver, you are responsible for ensuring that we have access to the venue at the agreed-upon time of delivery and you or your representative is available to receive the order.  Once you or your representative have signed to confirm receipt of the order, we are not responsible for any damage rendered to the order at the venue.

If we are unable to access the venue or there is nobody to confirm the delivery at the agreed-upon time, we may offer collection from our premises at a later time. Please ensure that we have correct contact details for the delivery date.

Collection is available by appointment only at the time set out in your quote or subsequently agreed to by us in writing.  We reserve the right to refuse access to you to collect your order outside your appointment.  Please inform us as soon as possible if you are delayed

Once you sign to confirm receipt of the order, we will not be responsible for any damage to the order whilst leaving our premises or in onward transit or assembly.

Storage and Best Before Date

Cakes and cupcakes should not under any circumstances be refrigerated nor should they be located adjacent to windows/doors/radiators as the heat can cause the quality of the product to deteriorate.  Due to the perishable nature of cakes and buttercreams, we do not recommend keeping your cakes longer than 3 days if sponge, 7 days for a Madeira cake and 14 days for fruit cakes. Our products are baked fresh for your order and therefore they do not have the extended shelf life of supermarket cakes, which contain additives/preservatives to prolong their life.

Allergies, Special Dietary Requirements & Non-Edible items

Please ensure we are aware of any allergies/intolerances that may affect your order.  We will inform you on request of any allergens in your order (and any available substitutions), however as our products are cooked and decorated in a domestic environment, we cannot guarantee an environment entirely free of allergens for preparation of orders.

Special occasion cakes may contain inedible items. Although we will inform you if this applies to your order, it is your responsibility to ensure these are removed by your caterer/guests before consumption.  This include support dowels in tiered and layered cakes, ribbon, wires in sugar flowers, flower picks & flower tape.  Most of our custom cake toppers contain inedible items and are not suitable for human consumption.

Satisfaction

In the unlikely event that you discover a problem with your order after receiving it, please advise us as soon as possible.  Where we agree that there is a problem, we will offer you a replacement, or a full or partial refund.  Please note, we may require the order to be returned to us in order to confirm that there is a problem and offer a refund.

Class cancellations/refunds

Unfortunately we do not offer refunds or transfers for cancellations/no shows so please double check you are available for the date you’re booking. If Avonside Cakery has to cancel a class due to unforeseen circumstances you will be offered a full refund or the option of transferring to another class.

Vouchers

Gift vouchers for classes must be redeemed within 12 months of the date of purchase. No extensions will be offered and as above it is your responsibility to make sure you can attend the class you have booked onto as no refunds or transfer will be offered. Using a voucher to purchase a class does not guarantee you a place on a particular date.
